The Practitioner was the victim of a third-party cyber fraud which resulted in the loss of $149,588.28 of his client’s money. The Practitioner failed to verify the banking details received by email with his client by telephone or otherwise confirm those details verbally which caused, or contributed to, the client’s loss. The Practitioner’s failure to take appropriate steps to ensure that funds were paid to the correct account resulted in a breach of: • Clause 13 of Schedule 2 of the Legal Practitioners Act 1981 (Act) by the disbursement of trust money otherwise than in accordance with the instructions of the client; and • Clause 23 of Schedule 2 of the Act by causing, without reasonable excuse, a deficit in a trust account. — Unsatisfactory Professional Conduct
